Transportation Law – 2023

Created in 2023 by the ALFA International Transportation Practice Group members, this 50-state compendium is an important resource.

The purpose of the Compendium is to provide a comprehensive source of information for ALFAI clients concerning relevant transportation law issues across the nation. The Compendium contains a quick reference for 17 common topics relating to transportation litigation. Some of these topics include:

• Factors determining discoverability or admissibility of preventability determinations and internal accident reports
• State permissibility of discovery of 3rd party litigation funding files
• Procedure for the resolution of a claim for injuries to a minor in your state
• Benefits or detriments of admitting a motor carrier is vicariously liable for the fault of its driver in the context of direct negligence claims
• Factors determining spoliation of physical and/or documentary evidence
• Whether actual medical expenses paid by insurance or others is discoverable and admissible
• Legal standard for obtaining event data recorder data from vehicle not owned by client
